He gained considerable notoriety on account of his suspected complicity in the murder of Sir Thomas Overbury, but nothing was definitely proved against him. He died on 15th June, 1614, at Northampton House, and, as Warden of the Cinque Ports, was buried in the chapel of Dover Castle.

Spencer died in 1610 ostensibly intestate, though Compton may have suppressed his will. Elizabeth inherited his properties and in 1632 they passed to her son, Spencer Compton, the 2nd Earl of Northampton.
