À l'origine, la loi du 20 mai 1802 concerne explicitement le maintien de l'esclavage dans les territoires qui n'ont pas appliqué la loi abolitionniste du 4 février 1794 : elle est liée au traité d’Amiens du 26 mars 1802 qui restitue les colonies de Martinique, Tobago et Sainte-Lucie à la France.
