Following his murder at the hands of his godson William Douglas, 1st Earl of Douglas, both baronies passed to his nephew, James Douglas, 1st Lord Dalkeith. James Douglas was confirmed in this position when his title was ratified by the Earl of Douglas prior to 1370.

The grant of Orkney and Shetland to the latter was disputed and they reverted to the Crown. Douglas, in 1672, resigned the Barony of Dalkeith. Sir James Douglas (d 1686) of Smithfield succeeded his nephew William and in 1669 James' son James Douglas (d 1715), 11th Earl of Morton, was granted Orkney and Shetland.

However he was briefly associated with the Kennedy faction, which controlled the minority government of James III between 1463 and 1466.

James Douglas, 1st Earl of Morton. James Douglas, (1426 - 22 October 1493), the 4th Lord of Dalkeith, was created the 1st Earl of Morton in 1458. He was the son of James Douglas, 2nd Lord of Dalkeith and Elizabeth Gifford, daughter of James Gifford of Sheriffhall.
