When his mother became duchess of Cleveland and countess of Southampton in 1670, he was allowed to assume the name of Fitzroy and the courtesy title of earl of Southampton.

Originally called James Crofts or James Fitzroy, he was born in Rotterdam in the Netherlands, the eldest illegitimate son of Charles II of England with his mistress Lucy Walter.

The second son of Charles FitzRoy, 1st Baron Southampton, FitzRoy entered the Army on 27 August 1779 with a commission as cornet in the 11th Dragoons, and in 1782 was made aide-de-camp to General Richard Whyte at Jersey.
